Welcome to DocGenie! We hope that you have a great experience using our DocGenie Telemedicine Platform.
These terms and conditions (“Terms and Conditions”) are between Pgenie India Private Limited, having its registered office at L-103, Park Place, DLF Phase 5, Gurugram -122010, Haryana, India, incorporated under the laws of India (hereinafter referred to as “DocGenie” “we,” “us,” or “our”) and you or the entity you represent (“you” or “your” or “User(s)”) and they shall govern your use of the DocGenie Platform (as defined below). Your access to the Platform is subject to your acceptance of the Platform Terms and such acceptance of the Platform Terms forms a legally binding agreement between you and DocGenie (“Agreement”). Please take your time to read the Platform Terms in their entirety.
Our agreements with you are structured as below and all of them are read together to form one document (collectively, the “Platform Terms”):
The Platform Terms along with their respective annexures, schedules, letters, addendums, amendments, shall collectively form one agreement (collectively the “Agreement”). The Platform Terms are executed in an electronic form and will become effective from the date specified as the effective date under the Principal Terms (“Effective Date”), unless otherwise stated and no physical execution shall be required. Upon complete execution of the Principle Terms, you will receive a copy of the same via email.
Your use of the Platform is conditional upon your compliance with and acceptance of these Terms & Conditions and the execution of the Principal Terms.
Please read the Platform Terms (as may be updated by us from time to time) carefully and thoroughly as this will govern your agreement with DocGenie. DocGenie shall, on a reasonable-efforts basis, endeavour to send a notification to you on your registered email (as set out in the Principal Terms) regarding any updates or changes to the Terms & Conditions, however, you must periodically visit the link specified in the Platform and read the Terms & Conditions. By visiting and accessing the Platform, providing your Personal Information (as defined in the Privacy Policy) or by otherwise signaling your agreement when the option is presented to you, you hereby expressly accept and agree to the Platform Terms. If you do not agree to any of the terms or do not wish to be bound by them, then please do not use the Platform in any manner.

DocGenie and the User shall individually be referred to as a “Party” and collectively as the “Parties”.
ABOUT DOCGENIE AND THE PLATFORM:The Platform is owned, managed, operated and offered by Pgenie India Private Limited, a company incorporated under the laws of India having its registered office at L-103, Park Place, DLF Phase 5, Gurugram -122010, Haryana, India (“DocGenie”). DocGenie is an online intermediary as defined under the Information Technology Act, 2000 and the rules thereunder, and provides telemedicine platform to facilitate the Services (as defined below).
In addition to the terms defined in the introduction and recitals to these Terms and Conditions, whenever used in the Platform Terms, unless repugnant to the meaning or context thereof, the following words and terms shall have the meaning assigned to them in this Section 1. All capitalized terms are defined/have the meaning assigned to it under these Terms and Conditions. In other words, if you find any word herein that has its first letter capitalized, then it means that we have explained the meaning such word has in the context of these Terms and Conditions and/or the Platform Terms; if not here, then it will be provided in the relevant Platform Terms – when we refer to any such term in these Terms and Conditions, we will try and specify where in the Platform Terms you can find the meaning/definition.
“Applicable Law(s)” shall mean any laws, ordinance, statute, rule, order, decree, Approval, notification, circular, bye-law, directive, guideline, requirement or other governmental restriction, or any similar form of decision of, or determination by, or any interpretation, policy or administration, having the force of law of any of the foregoing, by any authority having jurisdiction over the matter in question, whether in effect as of the date of the Platform Terms or thereafter.
“Brand Content” shall mean registered and unregistered trademarks owned and used by DocGenie as of the Effective Date, trade names, brand names including the Brand Names corporate names, word marks, logos, trade dress, design rights, service marks, tag lines and descriptors, domain names, designs, typography, colour palettes, internet sites, stationery, signage, promotional items, advertising and marketing materials, product names and other similar designations that are owned by DocGenie and/or its affiliates and any other intellectual property and materials which together constitute the brand image and language by which DocGenie is known to the public.
“Brand Name(s)” means “DocGenie” which is the name under which DocGenie along with its affiliates: (i) have developed the DocGenie Telemedicine Platform; (ii) established its brand image and presence in public.
“DocGenie Confidential Information” means and includes (i) oral and written information disclosed by DocGenie to You; (ii) all information, documents, data of DocGenie that is designated as confidential or that reasonably should be understood by You to be confidential given the nature of the information and the circumstances of disclosure; (iii) DocGenie Property (iv) login credentials (v) all information and materials (in whatever form or media) provided to the You by or on behalf of DocGenie (vi) documentation relating to your use of (i), (ii), (iii), (iv) and (v); (vii) information / content shared or disclosed by DocGenie to you under or in contemplation of the Platform Terms; (vi) correspondence and communication sent, exchanged or disclosed by DocGenie to you in relation to DocGenie Telemedicine Platform.
“DocGenie Telemedicine Platform” means collectively, (a) the Website along with the underlying Software, (b) Applications along with the underlying Software; and (c) any other websites, apps, and distribution mediums operated by DocGenie and/or its affiliates in the future, whether now known or subsequently invented at any time after the Effective Date
“DocGenie Property” means the (a) DocGenie Telemedicine Platform and its contents; (b) all content or other material available on the DocGenie Telemedicine Platform or through the code, and other images, text, layouts, arrangements, displays, illustrations, documents, reports, materials, audio and video clips, HTML and files; (c) Software; (d) Brand Content; (e) any software, illustrations, letters, images, ideas, concepts, reports and other presentations pertaining to the DocGenie Telemedicine Platform and/or DocGenie (including DocGenie’s affiliates); (f) DocGenie’s generalized practices, techniques, business processes, and know-how regardless of whether developed in connection with the DocGenie Telemedicine Platform, users or engagements with patients, Health Care Service Providers or other clients or vendors of DocGenie including the Intellectual Property; (g) analysis and reports generated on the DocGenie Telemedicine Platform; and (h) all intellectual property rights in, to, or under (a)-(g).
“Health Care Service Provider” means a physician, specialist, clinic, polyclinic, doctor, healthcare service provider who has a limited license to use the DocGenie Telemedicine Platform, for a platform fee, to provide Services to their own customers, patients, etc.
“Intellectual Property” shall mean the (a) Brand Content; and (b) DocGenie’s generalized practices, techniques, trade secrets, business processes, know-how, ideas, concepts, designs, policies, procedures, specifications, legal and regulatory affairs, discoveries, research and development, inventions, improvements, financial information (including current status and projections), strategic information (including goals and plans of DocGenie), technical information, processes information, engineering information, marketing and sales plans and information, computer files, source code, software products and services which may contain trade secrets, processes, formulae, proprietary programs, software packages, methods and procedures of operation, user's guides, instruction manuals, works of authorship, copyrightable works, inventions (whether patentable or not) and any and all other information not publicly known and of potential value to competitors, whether in oral, written, electronic, graphic, or machine-readable form, whether or not protectable under patent, trademark, copyright (including rights in computer software) and moral rights, database rights, utility models or other intellectual property rights, in each case whether registered or unregistered and including applications for registration, and all rights or forms of protection having equivalent or similar effect anywhere in the world.
“Person” shall mean any natural person, limited or unlimited liability company, corporation, partnership (whether limited or unlimited), proprietorship, Hindu undivided family, trust, union, association, government or any agency or political subdivision thereof or any other entity that may be treated as a person under any law.
"Services" shall mean the consultation, advice, medical advice, health advice, prescription, direction, guidance, suggestion, opinion, recommendation, services etc. provided by the Health Care Service Providers to the patient-users through the DocGenie Telemedicine Platform.
“Software” means in relation to the DocGenie Telemedicine Platform, all underlying software, underlying source and object code, instructions embedded in any form of digital documents, owned by or licensed to DocGenie and installed or delivered by DocGenie and/or its affiliates on software or hardware equipment used by You including (a) computers, diskettes, cloud, web hosting platform, CDs, and/or other media available to You by DocGenie; and (b) all data, information, or material residing on DocGenie’s and/or its affiliates’ computer servers.
“Term” shall mean the term of the Platform Terms and shall include the Initial Term and the Additional Term, if applicable.
“User Generated Content” means any content, information, message, suggestions, ideas, prescription, medical advice, comments, any opinion, recommendation, consultation or advice questions or other information, content that is sent, shared, delivered, submitted, expressed by any user on the DocGenie Telemedicine Platform.
“Website” shall mean DocGenie’s website at www.docgenie.in
In the Platform Terms, unless the context otherwise requires, the following rules apply:
All our collection, processing, sharing and storing of any Personal Information collected from you shall be in accordance with our Privacy Policy. Kindly read the same to understand the security measured undertaken by DocGenie to safeguard your Personal Information. Should have any queries in respect of the same, please feel free to right to us at support@docgenie.in . You have the option of uploading your identifiable health information including physical, physiological and mental health condition, and medical records and history on the Platform which may be accessed by your Health Care Service Provider at the time of private interactions using DocGenie Telemedicine Platform as per our Privacy Policy
If any User(s) submits suggestions, ideas, comments, or questions containing product feedback about the Platform or any of the Services, either through the Platform or otherwise (“Feedback”), then such User(s) grants DocGenie and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use (and full right to sublicense), reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display such Feedback in any form. Users shall have no intellectual property right in the Platform as a result of DocGenie’s incorporation of their Feedback in the Platform.
Your access to the Platform may occasionally be suspended or restricted to allow for repairs, maintenance, or due to the introduction of new facilities or services at any time without prior notice. We will attempt to limit the frequency and duration of any such suspension or restriction. You agree that DocGenie will not be liable for any losses that may be incurred by you if for any reason all or part of the Platform is unavailable at any time or for any period for use.
While DocGenie Telemedicine Platform is accessible worldwide; the Services and features offered are specifically targeted towards customers in India. If you choose to access and use the Platform from a location outside of India, you do so entirely at your own risk. You acknowledge and agree that the Health Care Service Providers listed on the Platform hold the necessary Approvals to provide the Services within India only. You are solely responsible for understanding and complying with the healthcare regulations and provider qualifications in your country of residence. By proceeding to use the Services from outside India, you expressly disclaim and waive any claims against DocGenie and/or the Health Care Service Providers related to their lack of registration or specific qualifications to practice medicine under the laws of your jurisdiction.
As a User, you may delete your account at any time by either writing to us at the email address provided under ‘Consumer Grievance’ section below or by using the delete option provided within your account on the Platform (if available). If your account is deleted (regardless of the reason), you will no longer have access to your account on the Platform; any deletion once processed is irrecoverable. DocGenie is not responsible for the loss of your information and/or User Generated Content upon deletion and DocGenie shall not be liable to any party in any way for the inability to access User Generated Content arising from any deletion. Please note that all accounts will remain active unless you explicitly ask us to delete it.
YOU AGREE THAT THE PLATFORM, CONTENT, AND ALL MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND YOUR USE OF THE PLATFORM SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, DOCGENIE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM AND EXCLUDE ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND YOUR USE THEREOF. TO THE FULLEST EXTENT PERMITTED BY LAW, DOCGENIE EXCLUDES ALL WARRANTIES, CONDITIONS, TERMS OR REPRESENTATIONS ABOUT THE ACCURACY, SECURITY, RELIABILITY, QUALITY, AVAILABILITY OR COMPLETENESS OF THE PLATFORM, USER-GENERATED CONTENT ON THE PLATFORM, OR THE CONTENT OF ANY SITES SO LINKED AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF USER-GENERATED CONTENT OR ANY CONTENT ON THE PLATFORM, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE PLATFORM, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY USER-GENERATED CONTENT OR ANY OTHER CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY USER- GENERATED CONTENT OR ANY OTHER CONTENT THAT IS POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM AS DOCGENIE IS STRICTLY AN INTERMEDIARY. DOCGENIE DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY USER- GENERATED CONTENT OR THE PLATFORM ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE PLATFORM OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND DOCGENIE WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF USER-GENERATED CONTENT OR SERVICES. AS WITH THE PURCHASE OF A SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
THE SERVICES AVAILABLE ON THE DOCGENIE TELEMEDICINE PLATFORM DO NOT IN ANY WAY CONSTITUTE AN INVITATION OR RECOMMENDATION TO AVAIL THE SERVICES. THE INFORMATION PROVIDED ON THE DOCGENIE TELEMEDICINE PLATFORM IS FOR INFORMATIONAL PURPOSES ONLY AND IS NOT INTENDED TO BE A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. YOU ARE REQUESTED TO ALWAYS CONSULT WITH A QUALIFIED HEALTHCARE PROFESSIONAL FOR ANY MEDICAL QUESTIONS OR CONCERNS.
DOCGENIE DOES NOT ENDORSE, INFLUENCE, OR CONTROL ANY PARTICULAR BRANCH OF MEDICINE.
PLEASE READ CAREFULLY: IT IS UNEQUIVOCALLY STATED THAT THE HEALTHCARE SERVICES ACCESSED THROUGH THIS PLATFORM ARE PROVIDED SOLELY BY THE INDEPENDENT HEALTH CARE SERVICE PROVIDERS LISTED ON THE PLATFORM, AND NOT BY DOCGENIE (PGENIE INDIA PRIVATE LIMITED). TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DOCGENIE EXPRESSLY DISCLAIMS ANY AND ALL RESPONSIBILITY AND LIABILITY FOR THE PROVISION, QUALITY, EFFICACY, SUITABILITY, LEGALITY, OR ANY OTHER ASPECT OF THESE SERVICES. DOCGENIE OPERATES STRICTLY AS AN "INTERMEDIARY" AS DEFINED UNDER THE INFORMATION TECHNOLOGY ACT, 2000, FACILITATING THE CONNECTION BETWEEN PATIENT-USERS AND INDEPENDENT HEALTH CARE SERVICE PROVIDERS, HEALTHCARE PROFESSIONALS, DOCTORS ETC. NO EMPLOYMENT, AGENCY, REPRESENTATIVE, PARTNERSHIP, OR ANY OTHER RELATIONSHIP EXISTS BETWEEN DOCGENIE AND THESE HEALTH CARE SERVICE PROVIDERS. DOCGENIE ASSUMES NO RESPONSIBILITY FOR, AND OFFERS NO ENDORSEMENT, WARRANTY, OR REPRESENTATION REGARDING THE CAPABILITY, SKILLS, QUALIFICATIONS, LEGITIMACY, PROFESSIONAL STANDARDS, OR ANY OTHER ATTRIBUTES OF THE HEALTH CARE SERVICE PROVIDERS. PATIENT-USERS ARE SOLELY RESPONSIBLE FOR EXERCISING THEIR OWN THOROUGH AND INDEPENDENT DUE DILIGENCE IN EVALUATING AND SELECTING A HEALTH CARE SERVICE PROVIDER.
DOCGENIE WILL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY FOR ANY FAILURE IN THE DOCGENIE TELEMEDICINE PLATFORM RESULTING FROM OR ATTRIBUTABLE TO (A) YOUR SYSTEMS; (B) NETWORK, TELECOMMUNICATIONS OR OTHER SERVICE OR EQUIPMENT FAILURES OUTSIDE OF DOCGENIE’S FACILITIES; (C) NEGLIGENCE, FRAUD, MISCONDUCT, INTENT TO DECEIVE BY YOU AND/OR ANY THIRD PARTY; (D) ANY ACTS OR OMISSIONS BY YOU OR ANY THIRD PARTY; (E) ANY FORCE MAJEURE OR CAUSE BEYOND DOCGENIE'S REASONABLE CONTROL, (F) SCHEDULED MAINTENANCE OR (G) UNAUTHORIZED ACCESS, BREACH OF FIREWALLS OR OTHER HACKING BY THIRD PARTIES; (H) YOURS OR ANY THIRD PARTY’S PRODUCTS, SERVICES, SERVICE OFFERINGS, (I) YOUR BREACH OF THE PLATFORM TERM. DOCGENIE WILL NOT BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY IN CONNECTION WITH THE SERVICES. IT IS EXPRESSLY CLARIFIED THAT DOCGENIE IS NOT THE PROVIDER OF THE SERVICES AND IN ITS CAPACITY AS A PLATFORM INTERMEDIARY, IS NOT RESPONSIBLE FOR ANY SERVICES AND/ OR USER GENERATED CONTENT AVAILABLE ON THE DOCGENIE TELEMEDICINE PLATFORM. DOCGENIE DISCLAIMS ANY AND ALL LIABILITY IN CONNECTION WITH THE SERVICES AND / OR USER GENERATED CONTENT.
You represent and warrant that: (i) all information provided by you to DocGenie is true, accurate, complete, and up-to-date; (ii) your use of the Platform and any content or materials you submit or upload will comply with all applicable laws, rules, and regulations; (iii) your use of the Platform and any content or materials you submit or upload will not infringe upon the intellectual property rights or other rights of any third party; (iv) you have the legal right and authority to use the payment methods provided (if applicable); (v) you have read, understood, and agreed to all the terms and conditions of this agreement without any duress or undue influence; (vi) you have the necessary rights and permissions to use and submit any content you upload to the Platform (if applicable); (vii) the content you submit is original and does not infringe upon the rights of any third party (if applicable); (viii) you have the legal right and capacity to enter into this agreement and use the Platform; (ix) if you are acting on behalf of an entity, you have the full authority and capacity to bind such entity to these terms and conditions; (x) you acknowledge and agree to the Platform's privacy policy regarding the collection, use, and disclosure of personal information; (xi) You agree to indemnify and hold harmless the Platform owner and its affiliates from any and all claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising from or relating to your use of the Platform, violation of these terms, or infringement of any third party rights.
The Agreement shall be governed by and construed in accordance with the laws of India; and you agree, as we do, to submit to the exclusive jurisdiction of the courts at India. All disputes arising out of these Terms and Conditions shall be first referred to arbitration as per the Arbitration and Conciliation Act, 1996.
